Acceptable Use Policy

 

1) Introduction
This Acceptable Use Policy is intended to govern the use of any service provided by Shout Hosting. Any violation(s) of this policy will result in either the suspension or termination of your service(s). In any instance of a dispute between you ("the client") and Shout Hosting regarding the interpretation of this policy, SHout Hostings interpretation, in its reasonable commercial judgement, shall govern.

2) Account & Script Security
The password to your account is your responsibility, Do not share this password with anyone.

 

Clients may not use Shout Hosting as any kind of script development platforms.

 

It is your responsibility to keep all third party scripts up to date and secure at all times.

 

3) Prohibited Content
The following content is prohibited:

 

Any site that Promotes or encourages the defeat, breach or modification of copyright protection schemes. This includes but is not limited to "cracks" and "warez".

 

Breaches or infringes on another person's trademark, patent or property right. This includes the storage and publication of written media, audio works and video of which you do not own copyright.

 

Serves as a distribution point or source of information for copyright infringement. This includes, but is not limited to, torrent sites, torrent forums, etc.

 

Material considered unfair or deceptive under the consumer protection laws of any jurisdication, including but not limited to: chain letters, "pyramid schemes", "ponzi schemes", "matrix schemes", etc.

 

Material purposefully set out to be malicious, fraudulent, or otherwise any content that can be deemed as illegal.

 

Proxy Site - We do not allow the hosting or operation of proxy sites on our servers.

 

IRC Activity - All IRC activity is prohibited on our network. This includes, but is not limited to, BNC's, IRC Servers and Eggdrop scripts.

 

The installation of third party scripts with the intention of downloading files from remote sites is strictly prohibited. This includes, but is not limited to, 'TorrentFlux', 'RapidLeech' and any other variation available.

 

The full list of probitited content is as follows;

 

IRC Bots, Proxy Scripts Anonymizers, FTP software, Pirated Software / Warez, image, filedump, mirror, or banner-ad services (similar to rapidshare, photobucket, or commercial banner ad rotation), affiliate servers, topsites, actual denial access monitors, commercial audio streaming (more than one or two streams), Escrow, Picture or file sharing scripts, High-Yield Interest Programs (HYIP) or related sites, Investment sites (FOREX, egold exchange), sale of any controlled substance without prior proof of appropriate permit(s), AutoSurf sites, Bank Debentures, Bank Debenture Trading Programs, Prime Banks Programs, lottery sites, muds / rpg's, hate sites, hacker focused sites/archives/programs, or sites promoting illegal activities, IP Scanners, Brute Force Programs, Mail Bombers and Spam Scripts. Forums and or websites that distribute or link to warez content are prohibited.

Online office software
Any application that is used as an online office is prohibited due to the content memory usage that they consume. Such applications may also allow teh sharing of files such as ducuments and images. This is also strictly prohibited as mentioned else where within our terms. Such application use a lot of memory, space and bandwith which often results is reduced server performance.

 

 

If you are unsure about content you intend to place on our network, please check with us before you do. We reserve the right to determine what constitutes acceptable use.

 

4) Resource Usage
Users may not:
a) Use 25% or more of system resources for longer then 90 seconds. There are numerous activities that could cause such problems; these include: CGI scripts, FTP, PHP, HTTP, etc.
b) Run stand-alone, unattended server-side processes at any point in time on the server. This includes any and all daemons, such as IRCD.
c) Run any type of web spider or indexer (including Google Cash / AdSpy) on shared servers.
d) Run any software that interfaces with an IRC (Internet Relay Chat) network.
e) Run any bit torrent application, tracker, or client. Please note that you may link to torrents off server, but may not host or store them.
f) Participate in any file-sharing/peer-to-peer activities
g) Run any gaming servers such as counter-strike, half-life, battlefield1942, etc
h) Run cron entries with intervals of less than 15 minutes
i) Use such an amount of bandwith that it effects the running of the server

 

When using PHP include functions for including a local file, include the local file rather than the URL. Instead of include("http://yourdomain.com/include.php") use include("include.php")

 

Misuse Of Resources - Including but not limited to applications which consume excessive CPU time, memory or storage space. Chat/IRC, web proxy and mailing list scripts are strictly prohibited on our network.

 

It is deemed as unfair usage if a user/account/domain exceeds 5% of the server space/bandwidth/CPU usage. All content and bandwidth used (including unmetered accounts) must be for web content only. Misuses of CPU resources are classed as the server load exceeding 2.0 at any given time for any one domain name account. 

 

resellers are trusted not to oversell their space to an extent that it effects our server. Resellers abusing this will be terminated if an agreement can not be made

 

bandwidth restrictions will be put into place if we deem the usage to be excessive and effecting other server users. This includes "unmetered" users and capped users as a whole.

 

accounts which exceed 300mb in total, weather the accounts is part of a restricted or unmetered package must be agreed by Shout Hosting prior to the content being uploaded. Failure to do this could result in the account being removed without prior notice for breach of contract.

 

Unlimited Accounts
Accounts previously referred to as unlimited are now known as unmetered. This relates to the space and bandwith that is consumed. However, this acceptable use policy still applies with the interest of all server lients in mind.

 

Unmetered users will have their accounts strictly monitored; account content must not break these terms and conditions, risking account termination if this policy is broken.

 

cPanel account limits
Reseller accounts are provided with 40 cpanel accounts. Further clusters of 10 can be purchased at £3.00 per month, per cluster.

 

5) Unsolicited E-Mail/Spam

You may not send any unsolicited e-mail to any person who has indicated that they do not wish to receive it.

 

We will not condone SPAM of any kind on our server.. "Safe lists" and "double opt-in" will also be treat as spam. Any user who sends out spam will have their accountsuspended and then terminated with or without notice.

 

Sites advertised via SPAM (Spamvertised) may not be hosted on our servers. This provision includes, but is not limited to SPAM sent via fax, email, instant messaging, or usenet/newsgroups. No organization or entity listed in the ROKSO may be hosted on our servers. Any account which results in our IP space being blacklisted will be immediately suspended and/or terminated.

 

Shout Hosting will NOT offer any alteration or correction period to any account holder involved in spamming. The account WILL be terminated

 

5.2) Email Restrictions

Unlimited Emails refers to the amount of inboxes that may be used with each account. This doesnt not include the amount of emails that each inbox may store and we ask our clients to empty all inboxes on a regular basis. excessive emails does use an amount of resources which may slow the server down.

Shout Hosting reserves the right to perform regular main server maintenance to purge any account that holds in excess of 200 stored emails. Fair notice of such maintenance will be given.

 

Shout Hosting also reserves the right to suspend or terminate any client should that particular account store in excess 500 emails on a constant basis dispite repated reminders being sent.

 

8b.) INODES
The use of more than 50,000 inodes on any shared account may potentially result in suspension. Accounts found to be exceeding the 50,000 inode limit will automatically be removed from our backup system to avoid overusage. Every file (a webpage, image file, email, etc) on your account uses up 1 inode.

 

Sites that slightly exceed our inode limits are unlikely to be suspended; however, accounts that constantly create and delete large numbers of files on a regular basis, have hundreds of thousands of files, or cause file system damage may be flagged for review and/or suspension.
The primary cause of excessive inodes seems to be due to users leaving their catchall address enabled, but never checking their primary account mailbox. Over time, tens of thousands of messages (or more) build up, eventually pushing the account past our inode limit. To disable your default mailbox, login to cPanel and choose "Mail", then "Default Address", "Set Default Address", and then type in: :fail: No such user here
